Mediation Provision


EMI recommends that when parties who believe in the benefits of Mediation are entering into prospective contractual agreements, that they include a Mediation Provision in every agreement, to encourage the parties to first pursue Mediation to resolve any potential disputes relating to the Agreement. A sample of such a Mediation Provision is provided here for your inclusion in your contracts.

Standard Mediation Provision for Entertainment Matters

Any controversy, dispute or claim arising in connection with the interpretation, performance or breach of this Agreement, shall first be submitted to Mediation at least 90 days prior to the initiation of any civil court, administrative or other legal action with respect to this Agreement. Such Mediation shall be initiated by either party wishing to make a claim by submitting such claim for Mediation to the Entertainment Mediation Institute, LLC (“EMI”) on EMI’s case submission form which can be requested or downloaded from the “Contact” page at http://www.EntertainmentMediationInstitute.com.

The Mediation shall be conducted at the offices of EMI at 468 N. Camden Drive, Suite 250, Beverly Hills, California, 90210 or at such other convenient location in Los Angeles County as the parties and the EMI Mediator may otherwise agree, with the exact time and location to be determined by the EMI Mediator in consultation with the parties. 

The EMI Mediator shall be selected by the parties from EMI's Mediation Panel within 10 days from filing the claim.  If no EMI Mediator is designated by the parties, or the designated EMI Mediator is not available, EMI shall designate an available EMI Mediator to mediate the dispute. Such Mediation shall be conducted in accordance with "EMI’s Standard Mediation Rules & Procedures", a copy of which may be obtained upon request through the above referenced EMI website.
